Metro Couple Asks Judge To Stop Foreclosure

ATLANTA — A metro Atlanta couple is hoping a judge will save their home from foreclosure.

Sonya Gilkey and her husband, Glenn, appeared in Fulton County Superior Court on Monday to ask a judge to keep Chase from taking their house.

"They have received a notice to vacate and they want that stopped," the Gilkeys' attorney, Charles Hall, told to Judge Jerry W. Baxter.

"We'll try to sort it all out, and I'll try to do the right thing," said Baxter before he ordered a temporary restraining order to stop any eviction until he can hear from both sides.

The bank didn't show up after an error with the court paperwork.

"Get everybody in here and I'm thinking you'll be OK," Baxter reassured the Gilkeys.

The Gilkeys told Channel 2's Jim Strickland they received assurances that the bank would not foreclose as their modification was in the works, even on the brink of foreclosure.

"The average person doesn't know what to do. Their first inclination is to move," said Sonya Gilkey.

"We're prepared to pay. We're not trying to get a free ride. We understand what it takes to deal with the system and meet our obligations," said Glenn Gilkey.

"All we want is a fair shake," said Glenn Gilkey.
