Police say Barabino robbed a Newk's restaurant, shot twice at a man in a white Mercedes in an alleyway and ran toward some apartments.

Channel 2 investigative reporter Mark Winne was the only reporter at the police station Friday as Barabino turned himself in to police.

“He’s charged with aggravated assault on a police officer, and another aggravated assault on another victim at Newk's along with armed robbery,” said Detective Tom Martin with the Brookhaven Police Department.

“I think everybody here's a little more relaxed that he's in custody and off the street,” said Newk’s manager David Scott.

Winne learned that after shooting at Sgt. Napier, Barabino allegedly drove away in his own car, which he flipped and ran from.

Attorney Rodney Williams told Winne after we contacted him Thursday afternoon -- about a dismissal he won on speedy-trial grounds in a previous armed robbery case against Barabino -- that he immediately went into action to arrange a peaceful surrender for his client's safety.

Williams said that was the first he knew Barabino was wanted. He said he spoke to Barabino's family, Brookhaven police and the DeKalb DA's office to arrange Barabino's surrender, which Barabino followed through on, on schedule.

“I called Sgt. Napier and let him know the suspect was arrested and he was pleased to know that,” Martin said.

“You have to give a shout-out to the Brookhaven Police Department. Obviously they got on this real quick, got the guy within a couple of days,” Scott told Winne.

Martin gave a shout-out to the work of the DeKalb Fugitive Unit as well.

In the older, dismissed case, records indicate Barabino had pleaded not guilty.

Channel 2 Action News asked for a comment from Barabino as he walked into the police station Friday, but he had no comment.
