Victim upset after felon allowed to stay out of jail for holidays

ATLANTA — Neighbors are upset that a convicted felon, sentenced to one year in prison, is allowed to stay home for the holidays before he's required to turn himself in to jail.

Law enforcement sources told Channel 2 Action News that it is not unusual for judges to allow convicted criminals time to get their affairs in order, or even spend the holidays with their families before making them report for their sentences.

Atlanta police arrested Fernando Carr for burglarizing a home in Northwest Atlanta. This week, he entered a guilty plea and was sentenced to one year of confinement.

Instead of making him serve time right away, Fulton County Superior Court Judge Cynthia Wright gave him until January 12, 2015 to report to jail.

The victim, who asked to not be identified, said Carr told the judge he suffered a gunshot wound and need to go to a doctor's appoint in early January.

"Victims should be able to have some closure especially around the holidays. If they are going to commit a crime, honestly don't deserve to have a holiday," said the victim.

Channel 2 Action News left a message with Wright about the case, but have not heard back.

"Do I feel comfortable that he's running around? Absolutely not," the victim said.
