Prominent attorney arraigned for murder

ATLANTA — A judge has yet to rule on whether a prominent attorney accused of killing his wife should be granted bail.

Tex McIver entered a not guilty plea in court Tuesday.

Channel 2's Dave Huddleston was in the courtroom where WSB-TV became part of the story.

Channel 2 investigative reporter Mark Winne did a jail house interview with McIver where he said he wasn't an expert on guns.

And from that, prosecutors sent out subpoenas demanding to see every gun that McIver owned be brought to court.

"It was given to Mr. Mark Winne, a very seasoned reporter with WSB-TV," prosecutor Mark Rucker told the judge Tuesday afternoon.

In than interview, McIver told Winne, "I’m not a gun expert, I had no training at all.”

Rucker said anyone who owns more than 30, knows something about guns.

Rucker subpoenaed McIver's friends, including Putnam County Sheriff Howard Sills, who is storing McIver’s guns. He ordered the sheriff to bring those guns to court.

"So I’m going to ask the court to deny bond for Mr. McIver," Rucker said.

But defense attorney William Hill said the subpoenas for guns was only a stunt for the television cameras.

"They have lost focus on this case," Hill said. "It was an effort by the DA to put every gun that Mr. McIver had on council's table."

McIver was sporting a gray beard and a blue prison jump suit Tuesday as he entered a not guilty plea for the killing of his wife Diane in September 2016.

After 3 1/2 hours of back and forth by the defense and prosecution, the judge still had not made a ruling on whether to grant McIver bail.

After McIver’s hearing the judge heard more court cases but by the end of the day Tuesday, the judge had yet to make a ruling regarding McIver’s bond, so he remains in jail.
