ATLANTA — UPDATE: The Landmark Diner in Buckhead was re-inspected and has recieved a score of 90. On July 21, they were inspected and got a 100. The Fulton County Health Department says the owners/managers of the restaurant will still need to appear in court to answer the citations issued when they received a score of 44 earlier this month. They must also offer a Corrective Action Plan.
A well-known diner in Buckhead failed its latest health inspection with a 44.
The Landmark Diner on Roswell Road has failed three of its last five health inspections.
The new score comes one week after getting 52.
Channel 2's Carol Sbarge learned that the diner was asked to voluntarily close but they refused and citations were issued Thursday.
Some violations that led to the failing score on June 3 include: Flying insects throughout facility, raw meat stored improperly, both ice machines filthy inside and observed dirty equipment throughout including shelves, coolers and gaskets.
One of the repeat violations found in the re-inspection was dented cans in the restaurant and some of the food items had expired including soda syrup from 2014.
Sbarge went to the Landmark Diner to ask why they had so many violations that would lead to an even lower score on the followup.
The founder of the Landmark Diners, Tom Lambrou, says they are retraining workers
"Sometimes the rush of the business, we're open 24-hours. We're very successful. Sometimes we fail," Lambrou said.
Lambrou says the violations were human mistakes that have been corrected. He says everything wasn't fixed by the second inspection but says they are now ready for the third inspection which is expected this week.
"We are clean. Feel very comfortable and it's routine," Lambrou said.
Fulton County says Landmark Diner voluntarily closed for eight hours Monday for maintenance.
Someone from the county inspection department is meeting with workers Thursday.
The citations will be heard in court on July 7.
