Police said Fordyce was trying to haul three TVs out of a Walmart on Lawrenceville Highway Sunday night when the loss prevention officer stopped him.

Investigators said the confrontation ended with Ferguson, a father of three, fatally wounded. Police said Fordyce is an unlikely suspect.

Fordyce is expected to appear in court Wednesday.

Warrants obtained by Channel 2 Action News show the gunmen used a 380 caliber handgun.

Police Wednesday said Fordyce hasn't given any explanation.

Ferguson's family released a statement calling the arrest bittersweet. While they are happy that a suspect has been apprehended, they said they are saddened by the fact that this arrest will in no way bring Ferguson back and now two men have been taken away from their families.

We have a reporter going into the jail for Fordyce’s court hearing and will have the latest starting on Channel 2 Action News starting at 4 p.m.
