68-year-old killed on riding lawn mower by man who was texting, driving drunk, Forsyth deputies say

FORSYTH COUNTY, Ga. — A 23-year-old Forsyth County driver has been indicted on multiple counts of homicide by vehicle.

In 2022, Kenneth Michael Johnson is accused of driving under the influence, recklessly, and killing a man who had been cutting his grass on a riding lawn mower.

As previously reported by Channel 2 Action News, Forsyth deputies said Johnson was driving drunk and texting on June 8, 2022. While rounding a curve on Hopewell Road near Church Road at high speed, he allegedly hit Paul Nix, 68, at around 4 p.m.

Nix was cutting his grass when Johnson allegedly crashed his Ford Fusion into him. Nix died at the scene, according to deputies.

Investigators told Channel 2 Action News at the time that Johnson had failed a field sobriety test, and that a cell phone was found on the ground near his car at the scene of the accident. He was then arrested.

The grand jury indictment against Johnson was filed in Forsyth County on May 9.

According to documents obtained by Channel 2 Action News, Johnson faces charges for four counts of homicide by vehicle, three counts of driving under the influence, and one count of reckless driving.

Johnson appeared to have been texting when the crash happened, according to the indictment.

At the time of his arrest, Johnson faced charges of driving under the influence, reckless driving, too fast for conditions, failure to maintain lane and writing/sending/reading texts while driving.

The indictment also says Johnson was driving “under the combined influence of alcohol and THC,” and “in excess of the posted speed limit.” His blood alcohol level was a reported .08 grams or more, according to the court record.
