ATLANTA — A former University of Georgia football player is speaking out about a tragic accident that killed his 3-year-old son.
Danny Ware says he can't fully mourn his youngest child because he's in a legal fight with his wife to get his son's body back to Georgia.
“I would come home from work and the first thing he would say is, ‘Jump me daddy, jump me daddy, pick me up daddy, let me get on your back,’” Ware said.
Danny Josiah Ware was killed Friday when he was struck by a truck as he rode his bike in a Houston, Texas neighborhood. According to police, Ware's wife was speaking with the driver right before it happened.
“I'm here as a heartbroken father trying to get answers as to what happened to my son,” Ware said.
Ware played for the Georgia Bulldogs and is a two-time Super Bowl winner. He and his wife have two sons. But he says she left him three days before the accident, taking both boys to Texas.
Now he's fighting to get Danny Josiah buried in Georgia, something he says his wife is blocking. He's also fighting to get his 5-year-old, Amaree Ware, back to Georgia as well.
“I'm just praying and having faith that the court will understand my argument. They will see that this is the best place for both of them,” Ware said. “My heart can't take much more of this. It's turned into something I never expected.”
Ware's attorney says a GoFundMe account to help with the burial was not set up by Danny Ware, but by UGA alums. And contrary to what people may think, he says Ware is not a multi-millionaire trying to get help with legal expenses. He says he's just a working father fighting for his sons.
