Family says man killed by police was 27-year-old father of four

ATLANTA — Family members say a man killed by an Atlanta police officer at a Wendy’s last night was the father of three girls and a had a stepson.

Rayshard Brooks, 27, was killed after he got in a confrontation with police at a Wendy's on University Avenue last night.

The family’s lawyers said Saturday night that Brooks’ daughters are 8, 2 and 1 and his stepson is 13. Brooks had been celebrating his daughter’s 8th birthday on Friday just hours before he was killed.

Attorneys L. Chris Stewart and Justin Miller have been hired to represent the family.

Miller said Brooks was supposed to take his 8-year-old daughter skating for her birthday.

“She had her birthday dress on. She was waiting for her dad to come pick her up and take her skating,” Miller said.

Video showed Brooks running from police an then pointing one officer’s Taser at him. Brooks was shot and killed by one of the officers. Atlanta Police Spokesman Carlos Campus told ABC News early Sunday morning that the officer has been fired.

“It’s like a video game, where you just think you shoot someone and its not an actual father or human being,” Stewart said.

On Saturday, after sharp criticism, Atlanta Police Chief Erika Shields resigned. Atlanta Mayor Keisha Lance Bottoms called on the officer who shot Brooks to be fired.

Hours later, police told Channel 2 Action News that the officer who shot Brooks had been fired. He’s identified as Garrett Rolfe, a nearly seven year veteran of the police force. A second officer, Devin Bronsan, is on administrative leave.

The GBI has been called in to lead the investigation. The District Attorney’s office is also reviewing the case.
