Lawyers question if 4 men in murder case killed victim

COBB COUNTY, Ga — Four men are on trial for killing a Cobb County man, but they may not be responsible for his death.

Cobb County jurors heard disturbing details Thursday about what led to the death on Mableton Parkway.

Johnathan Anthony, Antonio Pass, Jekari Strozier and Kemonta Bonds face murder charges.

Channel 2's Ross Cavitt first covered the story when it happened in June 2013, and followed the twists and turns in court on Thursday.

Store video showing an intoxicated and high Joshua Chellew, 36,  taunting the teens and flashing gang signs.

That taunt lead to a four against one fight that sent Chellew running into the street.

Keithon McMillian, who is not charged with murder or anything else, was driving down Mableton Parkway just as the fight ended and accidentally hit Chellew.

“I seen something, somebody ran across the street. I couldn’t really tell what was going on or who it was,” McMillan said.

Seconds later, McMillan hit Chellew, but had no idea what he’d hit even after he pulled over and checked on his car.

“After I ran over whatever I ran over, I got out the car. I didn’t hear anybody, see anybody, heard nobody yell, when I looked in my rearview mirror. I couldn’t even see anything lying in the road.”

McMillan heard about the accident the next day and called police after realizing that it was a far more tragic accident.

Another man, Nigel Clark, was also involved in the skirmish but is not charged because he ran when the fighting started.

Prosecutors say the four men are gang members but Clarke denied it.
