FAYETTE COUNTY, Ga.,None — Employees at a Fayetteville-based barbecue and seafood chain will receive more than $100,000 in back taxes after an investigation revealed violations against the Fair Labor Standards Act.
The U.S. Department of Labor launched an investigation against branches of This Is It! BBQ & Seafood in Fayetteville, Lithonia, East Point and two locations in Decatur. According to the investigation, employees were denied time-and-a-half pay for overtime, tipped employees were not paid the minimum wage, minors worked longer hours than legally permitted and the restaurants failed to maintain accurate records of tips earned and hours worked.
As a result of the probe, the Labor Department has recovered $104,089 in back wages for 230 restaurant workers. The department also fined the company $1,867 for allowing minors to work illegally late hours.
The restaurant chain has since agreed to keep accurate records and pay full and proper wages for all hours that employees work. The business has hired a payroll company to assist with overtime compensation.
