GWINNETT COUNTY, Ga. — Testimony continued Tuesday in the trial of a former police officer accused of shooting another officer and attacking a woman in February of 2008.
Jay Dailey is a former Duluth police officer charged with aggravated assault, terroristic threats, battery and possession of a firearm during the commission of a crime.
Testimony Under Way In Case Of Cop Accused Of Shooting Officer
Gwinnett County prosecutors say Dailey attacked a woman driving on Level Creek Road. They also accused him of a gun battle with an off-duty, but uniformed officer, who tried to intervene. Dailey was also injured and investigators said he was drunk at the time.
The first witness in the case, a 13-year-old girl, said she saw Dailey crash into a fire hydrant, according to Channel 2's Manual Bojorquez who was in the courtroom.
"He was walking kind of strange, and he came to her side of the road and that's when I got to be scared because I saw something in his hand that appeared to be a gun," the girl told jurors.
Dailey's defense attorneys told the court the former officer is a good man who made a mistake during a day when he simply wasn't himself.
"Fate or family dealt him a cruel hand because the evidence is going to be that he comes from a family with a long history of severe depression and alcoholism," said defense attorney Jeff Sliz.
Prosecutors convinced the judge to play audio taped statements made by Dailey before he was formally arrested.
A woman who claimed she was attacked by Dailey took the stand late Tuesday. Testimony was to resume Wednesday morning.
