Surveillance video shows moments before off-duty officer shot and killed man outside restaurant

ATLANTA — Surveillance video is showing the moments before an off-duty police officer shot and killed a man outside of a restaurant.

The shooting happened early Friday morning in the 500 block of Whitehall Street outside the Ivory Restaurant.

Attorney Leron Rogers, who represents the Ivory, says video of the weapon being pulled out of Duffy's SUV shows the danger the deputies faced.

"When you see the GBI pull an assault rifle out this big, you understand the gravity of the situation," Rogers said.

Rogers says Duffy, seen in the video raising his arm, had just been in an altercation inside of the restaurant. A taser had been used on him before he was allowed to leave with his brother.

A GBI spokesperson says the early indication is that Norris brandished the assault weapon and it was outside of his vehicle.

Duffy didn't fire but he was shot and killed.

But Rogers says the deputies acted appropriately given the circumstances.

"Not only did the deputies not do anything wrong, I think they acted appropriately and probably saved lives yesterday," Rogers says.
