Georgia man already under investigation arrested after gun found, drugs being used near infant

FLOWERY BRANCH, Ga. — A Flowery Branch man who was already being investigated for prior encounters involving drug use was arrested after police found a firearm and multiple controlled substances at his home.

According to the Flowery Branch Police Department, officers responded to a domestic dispute on Aug. 22.

During the investigation, officers said a subject had presented a firearm while intoxicated.

The subject was identified as 21-year-old Jacob Capes of Flowery Branch. Police said Capes was already under investigation for prior encounters involving drug use.

Investigators obtained an arrest warrant for Capes and a search warrant for his residence.

Police said they found a firearm and multiple controlled substances inside the residence.

Another person living at the home, identified as 21-year-old Tansley Bergerac of Flowery Branch, claimed ownership of the substances, according to police.

Police also said they discovered marijuana was being used in the presence of an infant.

Capes and Bergerac were taken into custody and transported to the Hall County Jail.

Capes was charged with two counts of reckless conduct and possession and use of drug-related objects.

Bergerac was charged with reckless conduct, disorderly conduct, possession of dangerous drugs, possession of a Schedule IV drug and drugs not in their original container.
