ATLANTA — Relatives of the woman married to former University of Georgia football player Danny Ware are speaking out about the legal battle they say has gotten out of control.
Ware was engaged in a battle with his wife, Cherylynn Ware, over where their 3-year-old son, Danny Josiah Ware, will be buried.
Ware wanted their son buried in Atlanta, while his wife wanted to bury the child in Houston.
A court ruled in favor of Cherylynn Ware and an appeal of that decision also failed.
During a previous interview with Channel 2 Action News, Danny Ware said, "I'm here as heartbroken father trying to get answers as to what happened to my son."
In a Skype interview, Ware's brother-in-law, Steven Hadley, says he wasn't happy with the messy legal battle.
"I said you know you do realize what you're doing to my sister your wife? And what you're doing to your son?" Hadley said. "He's going to be stuck in a mortuary for a month at least going through a legal battle for nothing for what?"
Hadley says Ware hasn't been a consistent figure in his children's lives as they prepare to bury Danny Josiah Ware Saturday.
The legal battle now shifts to a custody battle over Ware's other son.
"When you're an absentee father and that hid has been with his mother for his entire life, why would you do that?" Hadley asked.
Hadley says his sister is just trying to mourn and move on, but it's been hard.
"I couldn't handle it. The way she's handling it, I gave her kudos for that," Hadley said.
Ware has filed for divorce from his wife.
Ware's attorney says this shows the ugliness of divorce and custody issues. He also says Ware is not giving up, because he has been there for his kids.
