Police: Homeowner shoots, kills break-in suspect

GWINNETT COUNTY, Ga. — Police are investigating after they said a homeowner shot and killed a suspect breaking in to their home.

It happened in the 3000 block of Hadley Place in Snellville early Friday morning.

The suspect, identified as 25-year-old Michael Silva, went through the bathroom window and that was when the homeowner shot and killed him, police said.

Silva was found dead on the roof of the home.

No charges will be filed against the homeowner. Police say this was a self-defense shooting.

"At this point it appears the husband was well within Georgia law to protect his home and family," Gwinnett County Police Cpl. Deon Washington said.

Police said Silva, who lived less than 1/2 mile away, used a ladder to break inside the house but was met with gunfire when he tried to enter.

The homeowner shot Silva in the face, and he fell backwards, landing on the roof, police said.

Police said the homeowner called 911 and then grabbed his gun, but by that time, Silva was making his way through the window.

For hours neighbors thought Silva lived on the same block of the home he targeted.

Investigators confirm Silva lived close to the house, but say he wasn't directly connected to block.
