Airport Scuffle Lands in Court

Tales Differ Over What Happened at Terminal

Posted: 12:55 pm EST November 29, 2004

A Clayton County magistrate judge declined Monday to pursue charges against a Stockbridge woman who was pulled from her vehicle and thrown to the ground by an Atlanta police officer.

Diana Dietrich-Barnes

After the ruling, Diana Dietrich-Barnes said she may still pursue a civil case against officer Terence Alexander, who arrested the woman on Nov. 2 at the pick-up/drop-off point outside the terminal at Hartsfield-Jackson International Airport.

"I'm relieved (the case) has been dropped but I think something needs to be done to the officer who assaulted me," she said. "I've had nightmares, anxiety attacks (and) something needs to be done about that."

The Internal Affairs division of the Atlanta police agency has launched an investigation into what happened during the incident, which was caught on tape.

Dietrich-Barnes has alleged that the officer pulled her from her Ford Explorer and picked her up and slammed her on the concrete after she apparently did not move her vehicle from the terminal curb fast enough.

In his police report, Alexander wrote that he ordered the woman to move the SUV but that she screamed obscenities at him before striking him with her passenger side mirror when the vehicle began moving.

The officer's report indicates that the woman fought with him while he tried to restrain her.

The incident was captured on surveillance tapes posted at the airport. Charges against the woman, who was jailed following the incident, were dropped and the Clayton County solicitor declined to pursue the incident after watching the clip.

Alexander appeared before Magistrate Gloria Darty Reed Monday and tried to get the felony charges reinstated but the judge refused.

Lecora Bowen, an attorney for Alexander, said the decision by prosecutors and police brass to drop the case was unfair.

"When you see things and procedures like this, no on the part of the magistrate but on the part of the solicitor and the district attorney, not to allow this matter to go its proper course, I feel is really unconscionable.

Alexander wore a sling on his left arm, which he said was injured by the SUV's mirror. The officer has been placed on paid leave while the internal probe continues.

He and his attorney said they may bring new witnesses to prosecutors in their effort to get the charges reinstated.

Channel 2 Action News reporter Ross Cavitt contributed to this report.
