Judge sets trial date for Andrea Sneiderman

DECATUR, Ga. —

The Dunwoody widow accused of playing a role in her husband's slaying will stand trial this summer, a judge ruled Thursday.

Judge Gregory A. Adams set trial for July 29, and attorneys said they expected the case to last up to six weeks.

This week, a grand jury re-indicted Andrea Sneiderman on 16 counts including malice murder, felony murder, perjury and making false statements. Prosecutors removed previous charges of conspiracy and insurance fraud from the indictment.

Investigators believe Andrea Sneiderman manipulated her former boss and alleged lover, Hemy Neuman, into shooting her husband, Rusty, in November 2010, moments after he dropped their son off to Dunwoody Prep Preschool.

In court Thursday, the issue of one particular witness had defense attorneys sparring with District Attorney Robert James.

In November, then-chief assistant prosecutor, Don Geary, dropped a bombshell during a motions hearing, suggesting that Andrea Sneiderman may have been carrying on a romantic relationship with a man named Joseph Dell and that their relationship may have played a role in her husband's death.

Prosecutors added Dell to the list of witnesses, which prohibits him from having contact with Sneiderman, who is on home confinement awaiting trial.

"You had ample opportunity to investigate this. This case is 2½ years old," attorney Thomas Clegg said of prosecutors. "You put the man's name on a list of witnesses three months ago. Put up or shut up."

Clegg pointed out that prosecutors had yet to interview Dell about the case and he argued there's no evidence to suggest Andrea Sneiderman's relationship with Dell had any role in Rusty's murder.

"These two people are friends," said Clegg. "That's their business, nobody else."

District Attorney Robert James countered the appropriate time to "put up or shut up" would be at trial, and the appropriate time to object to a witness would also be at that time.

"Whenever the court calls us for trial, I'm ready to put up or shut up in front of whatever jury we pick," he said.

Adams indicated he would rule on the Dell issue in the near future. Andrea Sneiderman is set for arraignment on the new indictment March 15.
