Arrest Report: Babineaux Admits Smoking Pot

 

GWINNETT COUNTY, Ga. —

Atlanta Falcons defensive tackle Jonathan Babineaux and his friend were smoking marijuana while driving on I-85 north, according to a Gwinnett County Police Department arrest report.

Police released the arrest report to Channel 2 Action News about the Dec. 10 incident on Tuesday.

According to the report, Babineaux picked up his friend, Aaron Robinson, from Hartsfield-Jackson Atlanta International Airport Thursday night and then drove his friend to a townhome to buy marijuana.

Babineaux and Robinson both told police that Babineaux waited in the car while Robinson bought the marijuana.

Babineaux was driving a 2005 Cadillac Escalade EXT on I-85 north near Hamilton Mill Road about 10:45 p.m. when a Gwinnett County police officer stopped him for an equipment violation and expired registration, according to a release from Cpl. David Schiralli of the Gwinnett County Police Department.

"During the stop an odor of marijuana could be smelled by the officer coming from the interior of the vehicle," Schiralli said in the release.

According to the report, the officer asked Babineaux if there was any marijuana in the vehicle. The report stated "Babineaux looked scared and nervous. He rubbed his face and kept looking back at the vehicle."

"Gwinnett County Police K9 responded to the location and a positive alert to the odor of narcotics was given by the dog," said Schiralli.

During a search of the Escalade police found 41 grams of marijuana in three separate bags, according to Schiralli.

According to the arrest report, Robinson told police that “Babineaux smoked from the marijuana blunt at least two or three times but that (Robinson) smoked way more than Babineaux did.”

After initially denying smoking the marijuana at all, Babineaux did tell police he smoked from it once, according to the report.

Babineaux was charged with possession of marijuana weighing more than an ounce, driving without a license, driving with an expired tag, having material on his windshield or light and a faulty tag light. The booking information sheet shows that Babineaux was released after posting an $8,300 bond.

Robinson was charged with felony possession of marijuana weighing more than an ounce.

Friday, Babineaux released a statement that said, “I’m not guilty of these charges.”

Babineaux was drafted by the Atlanta Falcons in 2005. The Falcons signed him to a five-year, $25 million contract extension in November 2008.

Police arrested Babineaux on animal cruelty charges in 2007 after he allegedly killed his girlfriend's dog. Those charges were later dropped.
