Check your credit card statements; Ex-waiter facing felony charges

ROSWELL, Ga. — Roswell police have charged a former restaurant waiter with felony theft after they said he stole a customer’s credit card information.

Gregory Daniels told Channel 2's Mike Petchenik that he and his wife stopped at Peachtree Diner on Holcomb Bridge Road last Thanksgiving for a bite to eat on their way to visit family.

After they left the restaurant, he said his wife noticed some suspicious charges on their card.

“My tip was altered by $10. So whatever tip I put on there, he added $10 more. So that right away told me who was doing what,” Daniels told Petchenik from his home in Florida.

Daniels said he contacted the diner, which in turn contacted Roswell police.

Nearly a year after the fact, police said they were able to track the charges back to waiter Joshua Toney.

He was arrested earlier this month on outstanding warrants.

“He was making charges with the credit card information at the same time the person was there eating,” said Officer Lisa Holland.

Holland said detectives believe there could be other victims.

“It is possible he’s done this before and just didn’t get caught, so it is very important for the consumer to check their credit card statements each month,” Holland said.

Daniels said he’s made changes to his consumer habits in light of what happened.

“I don’t like letting my card get out of sight anymore,” he said. “It was premeditated, so I don’t think it was his first rodeo.”

Toney’s former co-worker Brian Rooney told Petchenik he never suspected anything.

“He seemed like a normal guy,” he said. “Didn’t seem like the criminal type.”

Rooney said he’s hopeful the arrest doesn’t reflect negatively on the restaurant.

“Nothing to do with Peachtree Diner,” he said. “It’s just one server here."
