Floyd County deputy on leave after man claims he used excessive force

FLOYD COUNTY, Ga. — A Floyd County deputy is on administrative leave and the GBI is investigating after a man was allegedly shocked with a Taser while in handcuffs.

Jauan Porter, 21, claims the deputy shocked him and roughed him up when he wouldn’t sign the paperwork agreeing to have his blood drawn.

"I'm thinking I'm about to die and they're about to get away with it, really," he said.

Police brought Porter to the jail around 5 a.m. last Sunday after he said he was jumped by four men and police said they found him drunk.

The man admits he was drunk, but said he was not being belligerent and did not deserved to be shocked with a Taser.

Porter shared photos of the bruises he said came from the incident.

The sheriff's office placed Sgt. Matthew Battle on administrative leave and the GBI is investigating the case.

A spokesperson for the sheriff's office said in a statement that Porter did not cooperate.

The statement obtained by Channel 2's Matt Johnson said: "Upon arrival to our facility he became belligerent, exhibited non-compliant behavior and was subsequently Tased by Sgt. Battle."

"I wasn't belligerent at all. I was just ... I know my rights and I know I'm not signing papers without reading it and they were getting mad about that," Porter said.

Johnson has filed an open records request for surveillance video from the jail, but was told there will be a delay since it is an open investigation.
