Driver accused of killing best friend, off-duty officer in crash set to surrender

ATLANTA — A defense attorney told Channel 2 Action News that his client, Aaron Lovely, 23, is preparing to surrender to authorities later this week, after investigators said Lovely caused the horrific crash that killed his best friend and an off-duty DeKalb County officer earlier this year.

The new developments come four months after the death of 21-year-old Tay Bostick and two months after the death of 32-year-old Ean Wells, who spent more than two months in the hospital before he died in July from his injuries.

A mother of one of the victims contacted Channel 2 Action News after, she said, she couldn't get any answers from investigators.

As soon as we contacted investigators, we started getting answers about the charges and about Lovely, who has been recovering at Shepherd Center.

"I just don't understand, and I'll never have my son back," Antoinette Bostick said.

Four months after she buried her son, the heartbroken mother is upset that no one has been prosecuted.

Bostick said her nightmare began in May, when the car crash happened on Memorial Road near Stone Mountain.

"It was a stormy night. I'll never forget it," Bostick said.

Police said the car, which was being driven by Lovely, swerved off the road and then flew into a parking lot, where it struck and critically injured Wells who later died. Tay Bostick, a passenger in the car, died at the scene.

"I think he needs to pay the consequences for his actions and I believe his actions were him speeding," Bostick said. "I don't want to hear, 'I'm sorry' because this is something that could've been prevented."

DeKalb County investigators said they had issued arrest warrants for multiple charges, including two counts of vehicular homicide, but as of Tuesday, the 23-year-old driver was not in custody because, investigators said, he's still recovering at the Shepherd Center, where he's been learning to walk and talk again.

But over the weekend, Tay Bostick's sister said she snapped a photo of the suspect walking around Ikea in Atlanta.

"He's had a traumatic brain injury as a result of the injury," said Jeffery Brickman, the defense attorney for Lovely.

Brickman said his client was at the store with his mother and is now preparing to surrender to authorities.

"We are making arrangements to self-surrender as soon as Thursday, and I've kept the Sheriff's Office and DA's office in touch to let them know his progress," Brickman said.

Brickman said this is a tragedy for everyone involved. He also said his client still doesn't know what happened.

Bostick said that, although her son was only 21, he loved working on cars and had big dreams of starting his own business.
