Cobb Families Win Suit in Drunk Driving Crash

Posted: 9:33 a.m. EDT August 5, 2003

Families of two teenagers killed by an underage drunken driver won a $40 million verdict Monday in a wrongful death lawsuit against the driver.

The driver, Sergio Montelongo-Sanchez, 20, is serving a 45-year sentence for vehicular homicide and other charges.

The families also entered into an undisclosed settlement Monday in Cobb County Superior Court with the owners of Dos Naciones, the bar where Montelongo-Sanchez said he drank 10 to 15 beers before driving.

On July 29, 2000, Montelongo-Sanchez's Lincoln Continental struck several cars before crossing the center line and colliding with a Honda Civic with four teens inside, police said.

Three of the teens died; a fourth was crippled. Montelongo-Sanchez had a blood alcohol level of 0.178, more than twice the legal limit.

Kenny Shackleford, father of one of the teens killed, said he knew that the likelihood of recovering money from Montelongo-Sanchez was slim. Montelongo-Sanchez is an illegal immigrant who likely will be deported by immigration officials once his sentence is completed.

But Shackleford added the case was intended to set an example for other drunken drivers.

"This award will perhaps make them think twice -- that if they terrorize the roadways after they've been drinking, the courts can come after them for everything they've got," Shackleford said.
