A grand jury indicted an Atlanta police officer Tuesday afternoon in connection with an off-duty shooting incident in May.

Fulton County district attorney Paul Howard said Officer Reginald Fisher of the Atlanta Police Department was indicted on two counts of aggravated assault, aggravated battery and violation of oath of office in connection with a shooting involving Tramaine Miller.

Miller was shot May 5 while visiting his aunt at her Richardson Street apartment. At the time of the incident, Fisher was working an unauthorized extra job when he attempted to detain and question Miller, according to Howard.

During the encounter, Fisher allegedly fired a close-range shot into the victim’s head striking his lower left jaw.

Police said a witness was able to clearly see Miller’s hands raised without a weapon offering no resistance to Fisher as the time the shot was fired.

Police said the investigation revealed that Miller was not involved in any illegal activity. He was invited by his quadriplegic aunt to her home to assist with her nightly medicine, police said.

Charges are also pending in Clayton County against Fisher for an unrelated domestic violence arrest in July 2009.
