Police in Gwinnett County said a boy was seriously injured after his intoxicated father crashed the car he was riding in.

Duluth police arrested Victor Roma-Ioera, 26, of Dacula, after the wreck Saturday at the intersection of Buford Highway and Pleasant Hill Road.

Police said Roma-Ioera was given a breathalyzer and registered a .126 blood alcohol level. The legal limit in Georgia is .08.

The man’s son, Kevin Romo-salas, was listed in critical condition at Children’s Healthcare of Atlanta at Scottish Rite. Police wrote in a warrant that the boy suffered brain damage.

Romo-Ioera previously pleaded guilty in 2005 to DUI, according to the Gwinnett Daily Post.

Romo-Ioera was charged with serious injury by vehicle and DUI-child endangerment. He was denied bond.
