Source: Only One Officer Was Shot

Posted: 4:11 pm EST November 29, 2006Updated: 6:25 pm EST November 29, 2006

Channel 2 Action News has learned major new details today in the controversial police shooting that left an elderly woman dead.

A source close to the officers involved now tells Channel 2 only one of the officers was hit directly with a bullet – the two others were hit with shrapnel. The source also says all the officers involved are in the process of getting lawyers.

A person who been in contact with some of the police officers involved in the deadly raid tell Channel 2 some of them feel like they have been subjected to a public flogging by wild, unsubstantiated accusations and innuendo. Not only are they upset over the death of 92-year-old Kathryn Johnston, they are angry over allegations that they participated in some kind of cover-up after coming to the realization of what happened.

In the chaos of the drug raid and fatal shooting of Kathryn Johnston, allegations have arisen which may or may not be borne out by facts.

One is that the elderly woman never fired a bullet at the three officers who burst into her home with a search warrant. But a source close to the officer involved says one, “…officer was wounded with a .38 caliber bullet – a round not used by police.” He continues to say, “They were shot at, they returned fire. You don’t gather facts on those shooting you while they’re in the process of shooting.”

After a confidential informant claimed police told him to lie about buying drugs at the woman’s home, family spokesman and activist Markel Hutchins yesterday raised the specter of a desperate attempt to hide a terrible mistake.

“If they’re not immune from lying, they’re not immune from shooting themselves in their bulletproof vests to cover up the wrongdoing that was done,” said Rev. Markel Hutchins Tuesday.

But a source familiar with the injuries of two officers, including the one that Channel 2 spoke with yesterday, say the wounds were caused by bullet fragments.

As for the claim that they shot themselves, “That ridiculous, you can’t shoot yourself with shrapnel.”

“I wish it would be more two-sided right now. You don’t have the information from our command to get two-sided with it cause they’re not releasing anything,” said an undercover officer.

One of the wounded officers told Channel 2 that he can’t comment on what happened.

But of the emotional state of the officers involved, Channel 2 was told, “Everyone is hurting right now. They want to be cleared and get back to work.”

As the FBI investigation into the shooting unfolds, some key areas to watch for – ballistics tests and the firing direction of rounds inside Ms. Johnston’s home. Phone records of the confidential informant and the type of information on which the search warrant was based.

The Magistrate Judge who signed the warrant today said she could not comment on the matter.
